1. THE STATE OF KARNATAKA, REP. BY ITS SECRETARY, EDUCATION DEPARTMENT, VIDHANA SOUDHA, BANGALORE – 560 001.
2. THE BANGALORE UNIVERSITY, REP. BY ITS VICE CHANCELLOR, BANGALORE-560 056.
3. THE REGISTRAR (EVALUATION), BANGALORE UNIVERSITY, BANGALORE-560 056.
4. Dr. RAMMANOHAR LOHIA COLLEGE OF LAW, NO.1 & 2, GOTTIGERE, (PANCHAYAT OFFICE ANNEX) BANNERGHATTA MAIN ROAD, BANGALORE-560 083.
REP. BY ITS PRINCIPAL …RESPONDENTS (BY SMT.PRAMODINI KISHAN, AGA FOR R-1;
SRI T.P.RAJENDRA KUMAR SUNGAY, ADV. FOR R-2 & R-3.) THIS REVIEW PEITION IS FILED UNDER ORDER 47 RULE 1 R/W 114 OF CPC, PRAYING TO REVIEW THE ORDER DATED 06.06.2017 PASSED IN W.P.No.22125/2014, ON THE FILE OF THE HON’BLE HIGH COURT OF KARNTAKA, BANGALORE.
THIS PETITION COMING ON FOR ORDERS, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Heard the learned counsel for the parties.
2. It is the grievance of the petitioner that no marks cards and certificates have been issued to him though he was permitted to appear for the examination in June 2014 in terms of one time measure scheme dated 14.11.2013. However, this Court while disposing of W.P.No.22125/2014, recording the submission made by the learned counsel for the respondent No.2 that marks cards and certificates have been issued to the petitioner, closed the matter as having become infructuous and the same requires modification.
3. Learned counsel for the petitioner reiterates the said grounds urged in the review petition. Whereas, the learned counsel for the respondent Nos.2 and 3 fairly submits that in view of number of petitions listed on that day i.e., 06.06.2017 relating to identical issues, the said submission was made and in the event, the marks cards and certificates, if not issued, respondent No.2 - University shall issue the same.
4. In view of the aforesaid, the order dated 06.06.2017 passed in W.P.No.22125/2014 is modified to the extent that respondent No.2 – University shall issue marks cards and certificates, if not issued, as the result of the petitioner is already declared.
With the aforesaid modifications, review petition stands disposed of .
