Sri Giri Prabhu Kumar Father’s name not known to petitioners Aged about 45 years Respondent nos. 3 and 4 are R/a.`Sai Nilayam’ No.170, 9th `C’ Main, T.C.Palya Kalkere NRI Layout Rammurthy Nagar Bengaluru 560 060. …Respondents (By Sri E.S.Indiresh, AGA for R1 and R2) This WPHC filed under Articles 226 and 227 of the Constitution of India by the petitioner praying to issue a writ in the nature of Habeas Corpus against the respondents to secure and to produce Prarthana Senthil Kumar and Skantha Sendhil Kumar Minor Grandchildren of the petitioners herein who are aged about 12 and 10 years respectively and direct the custody of the said Prarthana Senthil Kumar and Skantha Sendhil Kumar be given unto the petitioners and pass such other orders as may be deemed appropriate under the circumstances of the case.
This WPHC coming on for orders this day, K.N.Phaneendra J., made the following:
ORDER The first petitioner is present. Third respondent who is natural guardian-mother along with the children is present.
2. After hearing for some time, learned counsel for the petitioners seeks permission to withdraw the petition to work out his remedies in the G & WC case which is already filed before the Family Court in G & WC No. 243/18 against third respondent.
3. In view of the abovesaid submission, this petition is dismissed as not pressed. However, in view of the urgency pleaded by the petitioner, we direct the G & W Court to expedite the matter and dispose of the matter as expeditiously as possible.
