Patil, Advocate for R-2 R1 served and unrepresented) This writ petition is filed under Articles 226 and 227 of the Constitution of India praying to quash the letter dated 21.01.2014 and letter dated 19.02.2014 (Annexure-G & J) issued by the respondent No.2, holding the same as illegal, irregular opposed to the principles of natural justice and to direct respondent to consider application vide Annexure-B and the representation made by the petitioner vide Annexure-H and pass necessary orders thereon.
This writ petition coming on for Orders, this day, the court made the following:-
ORDER This writ petition is directed against the order dated 21.01.2014 and 19.02.2014 (Annexure-G & J), whereby, the 2nd respondent has rejected application of the petitioner for grant of LPG distributorship at Belakavadi, Mandya district, under open category.
2. Learned counsel for the respondent No.2 has filed a memo dated 13.02.2019 along the order dated 30.07.2018 passed by the 2nd respondent. The memo is placed on record.
3. On perusal of the order dated 30.07.2018, it is seen that during the pendency of this writ petition, the 2nd respondent had allotted the distributorship to one Mrs. Chandramma.C under the open category. In view of the subsequent orders passed by the 2nd respondent, the prayers sought by the petitioner in this writ petition do no survive for consideration and the writ petition has become infructuous.
In view of the above, the writ petition is disposed of as, having become infructuous, reserving liberty to the petitioner to challenge the allotment of distributorship made in favour of said Mrs. Chandramma.C., before the appropriate forum, if he is so advised.
