FOR R-2) THIS CRL.P IS FILED U/S 482 CR.P.C PRAYING TO QUASH THE CHARGE SHEET FILED BY THE 1ST RESPONDENT POLICE IN C.C.NO.10524/13 AT ANNEXURE-A FOR THE ALLEGED OFFENCES P/U/S 323, 506 R/W 34 OF IPC AND ALL FURTHER PROCEEDINGS IN C.C.NO.10524/2013 PURSUANT THERETO AT ANNEXURE-H ON THE FILE OF THE VII ADDL.C.M.M., BENGALURU.
THIS CRL.P COMING ON FOR ADMISSION THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER The petitioner and respondent No.2 and their respective counsels are present before the court.
2. Heard the parties and their counsels. Both of them have compromised the matter and compounded the offences. The second respondent who is the defacto complainant, on which basis CC No.10524/2013 came to be registered on the file of the VII ACMM, Bengaluru, has filed an affidavit before this court stating that, himself and the petitioner have compromised the matter and he has no objection to quash the proceedings against the petitioner.
3. The petitioner and the second respondent submit that they are close friends. However, due to some differences, the second respondent has filed a case against the petitioner for the offence punishable under sections 323, 506 read with 34 of IPC. The said offences are also not seriously punishable.
4. Under the above said circumstances and in view of their relationship, and as there is no legal impediment to accept the compromise and quash the proceedings, I pass the following:
ORDER The petition is allowed. Consequently, the entire proceedings in CC No.10524/2013 pending on the file of the VII Addl. CMM, Bengaluru, are hereby quashed.
