JUDGMENT / ORDER

THE HONOURABLE SRI JUSTICE C.V. NAGARJUNA REDDY WRIT PETITION No.32202 of 2014 Dated: 28.10.2014 Between:

ORDER:
This writ petition is filed with the grievance that despite spate of judgments of this Court, respondents 4 to 7 have been insisting on the petitioners, who are dealers in fertilizers, pesticides and seeds, to maintain the records manually.
In support of their plea, the petitioners have filed copies of orders dated 18.12.2008 in W.P.No.11624 of 1999 and dated 01.02.2013 in W.P.No.10404 of 2007. These orders, in unequivocal terms, laid down that the petitioners are entitled to maintain computerized stock registers and sale reports with regard to their business and that in the absence of any statutory provision, the respondents cannot insist on maintaining manual records.
The learned Assistant Government Pleader for Agriculture (A.P.) has fairly conceded that several orders passed by this Court to the above-mentioned effect have attained finality and that insistence on maintenance of manual stock registers and sale reports is contrary to the said orders. He has also assured that hereafter the authorities concerned in the State of Andhra Pradesh will not resort to such insistence.
The above-noted submissions of the learned Assistant Government Pleader are placed on record and respondents 4 to 7 are restrained from insisting on the petitioners to submit manual stock registers and sale reports with the further direction to them to accept the computerized stock registers and sale reports submitted by the petitioners.
The writ petition is accordingly allowed. As a sequel to the allowing of the writ petition, W.P.M.P.No.40260 of 2014 shall stand disposed of as infructuous.
