THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.30944 of 2014 Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) We are not inclined to entertain the Writ Petition, as it appears from the Chit Funds Act, 1982 there has been an alternative remedy by way of appeal. The question of jurisdiction of the Arbitrator has been raised. Even this question can also be taken up by the appellate authority.
Hence, we dismiss the Writ Petition. However, the petitioners will be free to approach appropriate forum in accordance with law for redressal of their grievance. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
