Respondents (By Sri Y.D.Harsha, AGA for R1-R3) This Writ Petition is filed under Articles 226 and 227 of Constitution of India praying to quash the endorsement Annx-J dated 16.01.2012 issued by R3 and direct the CID or CBI (Central Bureau of Investigation) to conduct the investigation into the complaint dated 26.12.2011 of the petitioner under Annx-G.
This Writ Petition coming on for Hearing, this day, the Court made the following:
O R D E R The very petitioner has filed the petition in W.P.No.15018/2012 against the Central Government alleging that the Regional Passport Authority has not considered the complaint and this Court by an order dated 23.07.2019 allowed the writ petition and directed respondent-The Regional Passport Officer, Koramangala, to consider Annexure–G and pass appropriate orders.
2. The authorities under the Passport Act, 1967, has to decide the very complaint. The Commissioner of Police, Bengaluru has issued the impugned endorsement dated 16.01.2012 on the complaint made by the petitioner. The said endorsement was unnecessary and it is the petitioner who invited such endorsement.
3. In view of the fact that matter is seized before the passport authorities, the endorsement issued become redundant.
4. It is for the passport authorities to consider Annexure-G and pass appropriate orders.
In view of the above, writ petition filed by the petitioner is misconceived. Accordingly, writ petition is disposed off.
