Heard learned counsel for the petitioner as well as learned Government Pleader for Home appearing for the respondents.
The petitioner states that he is the owner and possessor of land admeasuring Ac.3.50 cents in R.S.No. 16/1G situated at P. Rajavaram village, Jellugumilli Mandal, West Godavari district. He alleges that on 7.8.2014 at about 9.00 A.M. a group of tribes entered into his land with sticks and were not allowing him to cultivate the land and warned him not to cultivate the land. The petitioner gave a complaint on 7.8.2014 to the respondent No.4 for necessary action, but no action was taken on his complaint nor any police protection was provided to him. Alleging inaction on his complaint, the petitioner has filed the present writ petition.
Learned Government Pleader for Home appearing for the respondents was directed to get instructions and on instructions, he submitted that no case was registered with the respondent No.4 on the complaint dated 7.8.2014 given by the petitioner. Hence the case was adjourned. Subsequently the learned counsel for the petitioner has filed some additional material papers including copy of FIR in Cr.No. 124 of 2014 and reports of revenue authorities and submits that on a subsequent complaint dated 18.10.2014 given by the petitioner, a case in Cr.No. 124 of 2014 was registered under Sections 447 and 506 r/w. 34 I.P.C. against the culprits and reports from the Village Revenue Officer and Mandal Revenue Inspector were called for and received by the respondent No.4.
It is evident from the above material that a case has already been registered on the complaint given by the petitioner and reports of the revenue authorities concerned were also obtained by the respondent No.4 on the said complaint. Therefore, this writ petition is disposed of directing the respondent No.4 to make investigation on the basis of the F.I.R. and take appropriate steps in accordance with law expeditiously. Miscellaneous applications, if any, shall stand closed. No order as to costs.
