Heard learned counsel for the parties.
This is a transfer application seeking transfer of a suit for cancellation of a sale deed instituted by the applicant at Gautam Budh Nagar.
Transfer of this case is sought to district Agra on the allegation that the son ofone of the defendants is the steno of the SDM, Jewar. He is not permitting the counsel to appear in the matter.
This bald allegation cannot be accepted.
On a pointed query as to whether any complaint in this regard has been made before the court concerned, counsel for the applicant has no answer.
Even otherwise, in my considered opinion, the Court of the SDM is not a civil court and, therefore, this Court fails to understand as to how the steno of SDM can an influence the proceedings before the civil court.
Besides no specific allegations have been made in the transfer application as to how the steno of the SDM, Jewar is influencing the suit proceedings.
This transfer application is, accordingly, rejected.
