Sri Krishna Rawat And Ors. vs Sri Ramesh Chandra Mishra ...

High Court Of Judicature at Allahabad|13 April, 2012

JUDGMENT / ORDER

Sri L.K. Pathak, learned counsel for the petitioners submits that vide order dated 04.08.2011 passed in the writ petition No. 4956 (S/S) of 2004, this Court has extended the benefit of the order dated 21.03.2005 passed in the writ petition no. 2790 (S/S) of 1998, where a direction was given to the opposite party that the petitioners shall continue as Machine Assistant Offset and will be entitled to the pay-scale of Rs. 1200-1800. Learned Counsel for the petitioners submits that against the said orders the second appeals and SLP have been dismissed. Thus, the impugned order has attained the finality.
Learned counsel further submits that in spite of numerous requests, the opposite parties have allowed the petitioners to continue the work but neither the post nor the scale has been given. Thus, the contempt has been committed.
In view of above, I direct the opposite parties to comply the direction given by this Court within a period of two weeks, failing which, they will have to appear before this Court to show cause as to why the contempt proceedings may not be initiated against them.
Learned Standing Counsel will also seek instruction in the matter.
In addition, learned counsel for the petitioners shall also inform the opposite parties about this order, in writing, within a period of one week.
List on 04.05.2012.
