ORDER: (per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta)
We are of the view that in this matter, counter-affidavit is not required to be filed. Hence, we dispose of the Writ Petition by the following order.
From the records, it does not appear that any specific representation is made to the Andhra Pradesh Pollution Control Board. However, a copy of the complaint made to the Collector appears to have been forwarded. There is no document to show that this has been received by the Andhra Pradesh Pollution Control Board.
In the circumstances, we direct the Andhra Pradesh Pollution Control Board to treat the copy of the Writ Petition as complaint, enquire into the matter and take steps in accordance with law. In the process, persons who might be affected shall be served with notice before taking adverse steps.
Consequently, miscellaneous petitions, if any pending, shall stand closed. No order as to costs.
