Respondent (By Sri S.Rachaiah, HCGP) This Criminal Petition is filed under Section 438 of Criminal Procedure Code praying to enlarge the petitioner on bail in the event of his arrest in Crime No.107/2019 of Ashoknagar Police Station, Bengaluru City for the offence punishable under Sections 406, 409, 420, 468 and 471 of IPC.
This Criminal Petition coming on for Orders, this day, the Court made the following:
ORDER After hearing the matter for some time, the learned counsel for the petitioner submits that petitioner is always willing to co-operate with the investigation and to show his bonafides, he would surrender himself to enable custodial interrogation. At this juncture, learned HCGP points out that custodial interrogation will be completed expeditiously and states that they would complete the custodial interrogation within a period of 3 days, if there is adequate co-operation from the side of the petitioner.
2. Taking note of the said submission made by the learned counsel for the petitioner and also the submission of the learned HCGP, the petition is disposed of as requiring no further order.
3. The liberty however is reserved to the State to seek for extension of custody for the purpose of further custodial interrogation while filing the application for remand, if circumstances and facts so warrant.
4. The plea of the petitioner for regular bail is to be considered expeditiously.
5. In light of the submission of the counsel for the petitioner, the petitioner to present himself before the CID, Special Wing at 11.30 a.m., on 22.07.2019.
6. Copy of the order to be furnished to the learned counsel for the petitioner and to the learned HCGP. Accordingly, the petition is disposed of.
