JUDGMENT / ORDER

Heard learned counsel for the appellant on the Substitution Application No. 186024 of 2010, filed by him.
this application has been preferred to substitute the legal heirs of Kedar Nath (Appellant No. 1) who has expired on 11.5.2010.
The application is within time and filed by heir and legal representative.
Hence, the substitution application is allowed. The heirs and legal representatives of Appellant no. 1 are taken on record.
Office is directed to carry out necessary correction in the Memo of Appeal.
It is an admitted appeal thus office is directed to send a requisition for lower court record.
List for final hearing alongwith lower court record in usual course.
