HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.37973 of 2014 ORDER:
The grievance of the petitioner is that he has presented the Deed of Conveyance concerning the property to an extent of 126.91 square yards in Survey Nos.678/1 and 679, situated at Ward No.1, Srinagar Colony, Chinnachowk Village, Kadapa Town and District. The Joint Sub-Registrar, Lakkireddypalle Village and Mandal, Kadapa District (1st respondent) received the document and assigned P.No.32/2014 presented on 19.11.2014, but so far, he has neither registered nor communicated reasons for not registering the document.
2. Learned counsel for the petitioner contends that it is illegal on the part of the registering authority not to communicate the reasons for not registering the document and cannot keep the document pending for such a long time.
3. Having regard to the submissions made, without expressing any opinion on merits, the Writ Petition is disposed of directing the Joint Sub-Registrar, Lakkireddypalle Village and Mandal, Kadapa District (1st respondent) to process the document bearing P.No.32/2014 in accordance with the Registration Act, 1908, and the Indian Stamp Act, 1899. If the document is in order, he shall register and release the same. If the Joint Sub-Registrar is of the opinion that the document cannot be registered, he shall assign due reasons, pass an order and communicate the same to the petitioner within a period of two (2) weeks from the date of receipt of a copy of this order. It is open to the petitioner to work out his remedies, if the first respondent refuses to register the document. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
