THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER The petitioner herein is a Trust, which is formed for the benefit of Sri Kabbalamma deity of Byravanadoddi Bidadi, Ramanagara. The grievance of the petitioner-Trust is that an extent of 2 acres 22 guntas in Sy.No.33 of Avaragere village, Bidadi Hobli, Ramanagara Taluk, was gifted by one Smt. Revamma W/o Devaraj under the registered Gift Deed 12.07.2004 in favour of the petitioner-Trust. In spite of having acquired the said land by way of registered Gift Deed by the petitioner-Trust, the same is not considered for transfer of Khata by the respondent No.1-Tahsildar in favour of the petitioner-Trust.

Learned Additional Government Advocate for the respondents would bring to the notice of this Court that the Gift Deed dated 12.07.2004 vide Annexure-A is not a registered document and therefore, the same cannot be considered. However, the said submission of the learned Additional Government Advocate is countered by the learned counsel for the petitioner on the ground that the said gift deed is already registered.
4. In any event, if the gift deed is already registered, the petitioner shall furnish copy of the registered gift deed to the first respondent-Tahsildar within 15 days from the date receipt of copy of this order and thereafter the respondents-1 and 2 shall take necessary steps to register the said land in favour of the petitioner-Trust within 60 days.
With such observation, this writ petition is disposed of.
Learned Additional Government Advocate is permitted to file memo of appearance within two weeks.
