JUDGMENT / ORDER

The Secretary, Regional Transport Authority, Mandya – 571401. ... Respondent (By Sri.Dildar Shiralli, HCGP) These Writ Petitions are filed under articles 226 and 227 of the Constitution of India praying to direct the respondent to convene a timings conference in respect of subjects No.106/2000- 2001, 71/2004-2005 and subject No.139/99-2000 as per serial Nos.17, 18 and 56 of Annexure-A and pass an order for revision of timings as early as possible preferably within a period of four weeks and etc.
These Writ Petitions coming on for Preliminary Hearing, this day, the Court made the following:-
O R D E R The short grievance of the petitioners who claim to hold stage carriage permit for the routes in question is against the non convening of Timings Conference in respect of subject Nos.106/2000-2001, 71/2004-2005 and 139/1999-2000 as per Serial Nos.17, 18 and 56 as enlisted in the Agenda Notice dated 14.09.2009 at Annexure-A despite representations and requests.

The learned counsel for the petitioners Sri.B.R.Sundara Raja Gupta vehemently contends that this business of Convening Timings Conference has been kept in vain for several years by the jurisdictional officers who have come and gone without turning a leaf and therefore, the indulgence of this Court is eminently warranted, to activate the authorities of the Department of the Government.

The learned HCGP Sri.Dildar Shiralli, on request appearing for the respondent having opposed the Writ Petition for a short while, now fairly submits that the decision as to Convening of Timings Conference needs to be taken, is true; however because of heavy work load, it appears that the convening of conference is deferred indefinitely; now that the same having been brought to the notice of the Court, he would instruct the jurisdictional authority to do the needful within a reasonable period as may be prescribed by this Court, subject of course, to the co-operation from the side of the petitioners as well. This sounds reasonable.
4. In the above circumstances, this Writ Petition succeeds in part; a Writ of Mandamus issues directing the respondent to convene the Timings Conference and transact the business in respect of the subjects enlisted in the Agenda Notice dated 14.09.2009, Annexure-A, within four weeks in accordance with law.
