…Respondents (By M.B.Chandra Chooda, Advocate for R1 to R4) This HRRP is filed under Section 46(1) of the Karnataka Rent Act, 1999 against the order dated 27.03.2019 passed in HRC No.40/2018 on the file of the Chief Judge, Court of Small Causes, Bengaluru, allowing the petition filed under Section 27(2)(r) of Karnataka Rent Act, 1999 for eviction.
This HRRP coming on for admission, this day, the Court made the following :
ORDER A joint memo is filed by the petitioner and respondent No.3. According to this memo, the petitioner has undertaken to vacate and hand over the vacant possession of the schedule shop to the respondents on or before the end of February 2022. Respondents have no objection for giving time to the petitioner till the end of February 2022 to vacate the schedule shop on the condition that the petitioner should pay the rent to them at the rate of Rs.4,968/- per month from 1.9.2019 onwards. Memo is signed by the petitioner and the third respondent in his individual capacity and also as GPA holder of respondents 1, 2 and 4. The respective advocates for the parties have also signed this memo.
2. Memo is placed on record. Petitioner is given time till the end of February 2022 to vacate and hand over vacant possession of the schedule shop to the respondents. Petitioner is directed to pay rent at the rate of Rs.4,968/- per month from 1.9.2019 till he vacates. Accordingly, the petition stands disposed of.
