(BY SRI VENKATESH DODDERI, AGA FOR R1 TO R3) THESE WRIT PETITIONS ARE FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE RESPONDENT NO.3 TO CONSIDER THE REPRESENTATION OF THE PETITIONER AT ANNEXURE-J AND K DATED 28.05.2018 AND DIRECT HIM TO MUTATE KHATA CONCERNING THE SCHEDULE PROPERTIES IN FAVOUR OF THE PETITIONER.
THESE PETITIONS COMING ON FOR HEARING- INTERLOCUTORY APPLICATION THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R These petitions stand disposed off at this stage itself, with the consent of the parties.
2. Petitioner is aggrieved by the inaction of the respondent No.3 in not considering the representation of the petitioner at Annexure-J and K dated 28.05.2018 whereby, the mutation of khata relating to the properties in question has been sought for. Impleading applications are filed by the applicants to come on record as additional respondents to the writ petition.
3. Considering the totality of the circumstances of the case, this court is of the considered opinion that the justice would be sub-served in directing the respondent No.3 to consider the representation of the petitioner dated 28.05.2018 at Annexure-J & K to the writ petition and take a decision in the matter after hearing the petitioner as well as other interested parties including the impleading applicants herein, in accordance with law and is ordered accordingly. This exercise shall be made by respondent No.3 in an expedite manner.
With the aforesaid observations and directions, writ petitions stand disposed off.
In view of the aforesaid, all the pending I.As stand disposed off.
