By its Managing Director. ...Respondents (By Sri.Dildar Shiralli, HCGP for R1; Sri.Raponakhopadhayay, Advocate for Sri.M.S.Harish Kumar, Advocate for R2) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to quash the order of the Karnataka State Transport Appellate Tribunal passed in Revision Petition No.710 of 2012 dated 08.05.2015 marked under Annexure - B and etc., This petition coming on for orders this day, the Court made the following:
ORDER Heard the learned counsel for the respective parties.
2. The petitioner has challenged the order passed by the Karnataka State Transport Appellate Tribunal in Revision Petition No.710 of 2012 dated 08.05.2015 vide Annexure `B’. The Tribunal has allowed the Revision Petition filed by the Karnataka State Road Transport Corporation – respondent No.2 herein, setting aside the order passed by the respondent No.1 dated 09.04.2012 in renewing the permit of the petitioner herein.
3. Learned counsel appearing for the parties ad idem submit that the permit of the petitioner is saved under the notification dated 28.09.2017 and the matter requires reconsideration by the respondent No.1.
4. In view of the aforesaid submission, the order impugned at Annexure `B’ dated 08.05.2015 is set aside and the proceedings are restored to the file of the respondent No.1 for reconsideration. The respondent No.1 shall reconsider the application filed by the petitioner for renewal of the permit, in the light of the notification dated 28.09.2017 and shall take a decision in accordance with law, after hearing the parties, in an expedite manner, in any event, not later than twelve weeks from the date of receipt of the certified copy of the order.
With the aforesaid observations and directions, writ petition stands disposed of.
