… PETITIONER … RESPONDENT THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT RESPONDENT TO CONSIDER THE ANNEX-B DATED 07.04.2015 BY WAY OF WRIT OF MANDAMUS AND DIRECTIOSN TO THE RETURN THE ORIGINAL SALE DEED DATED 09.02.1995 AND OTHER RECORDS TO THE PETITIONER AND ETC.
THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Mr.Jagadeshachari, learned counsel for the petitioner.
None for the respondent.
2. In this petition, the petitioner inter alia seeks for a direction to the respondent-Bank to consider and decide the representation dated 07.04.2015 submitted by the petitioner for return of the documents.
3. When the matter was taken up, learned counsel for the petitioner submitted that even though the petitioner has repaid the entire amount of loan, yet till today the original documents of the petitioner have been returned to him. It is further submitted that in any occasion the petitioner has submitted the representation contained in Annexure-B and the writ petition be disposed of with a liberty to the competent authority of respondent-Bank to decide the same by a speaking order.
4. In view of the submissions made and in the facts of the case, the writ petition is disposed of with a direction to the competent authority of respondent- Bank, to decide the representation submitted by the petitioner within four weeks from the date of receipt of a certified copy of the order passed today by a speaking order and in accordance with law.
Accordingly, the petition is disposed of.
