Sri.V.Haridas Bhat, learned Counsel for Respondent In this petition filed under Articles 226 and 227 of the Constitution of India, the petitioner interalia has assailed the validity of the Proclamation issued by the first respondent dated 14.09.2016 as at Annexure – ‘A’.
2. When the matter was taken up today at 1.22 p.m., learned counsel for the second respondent – Bank submitted that in response to the Sale Notice, sale has not taken place. Therefore, nothing survives for adjudication in this petition.
3. In view of the aforesaid submission, writ petition is disposed of with liberty to the petitioner to take recourse of such remedy as available to him under the law.
