For R1 and R2, vakalath not filed) This Writ Petition is filed under Article 226 of Constitution of India, praying to set aside the endorsement/enquiry report bearing No.Nil, dated 29.07.2016 of the 2nd respondent vide Annexure-S as illegal, arbitrary unsustainable and opposed to BDA site allotment Rules.
This Writ Petition coming on for Preliminary Hearing in ‘B’ Group this day, the Court made the following:-
ORDER Learned counsel for the petitioner has filed a memo stating that the reliefs sought in the writ petition have become infructuous since the respondent-BDA has allotted a site at the 8th attempt made by the petitioner. In view subsequent development, the petitioner prays dismissal of the writ petition as not pressed.
Memo for withdrawal is accepted.
Accordingly, petition is dismissed as withdrawn.
