THIS CRIMINAL PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER In the course of arguments, learned counsel for the petitioner Sri. P. Prasanna Kumar, brought to the notice of this Court that, in Spl.CC. No. 80/2016 the trial has already been commenced and now the case is posted for recording of the statement of the accused u/s.313 Cr.PC.
2. In spite of the submission of the learned counsel for the petitioner, it is not shown to the court as to what is the evidence adduced by the witnesses. Therefore, it would amount to appreciation of the material on record before the trial Court, if this court ventures upon to deal with the matter on merits. Therefore, I am of the opinion, it is just and proper to direct the trial Court to dispose of the case within one month from the date of receipt of a copy of this order, after recording 313 statement of the accused.
With the above observation, the petition is disposed of. However, the trial Court is directed to dispose of the case within one month from the date of receipt of a copy of this order.
