…RESPONDENT (BY SRI ADITYA SINGH, LEARNED CGC FOR SRI C.SHASHIKANTHA, ASGI) THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE DIRECTION TO THE RESPONDENT AUTHORITIES TO CONSIDER THE LETTER ISSUED BY THE PETITIONER AS ON 12.02.2018 VIDE ANNEXURE-J AND DIRECT THE RESPONDENT TO RENEW THE PASSPORT OF THE PETITIONER MADE UNDER FILE NO.B.N.2078595260915 FOR RENEWAL OF THE PASSPORT BEARING NO.F9463539 AS IMPUGNED IN ANNEXURE-A DATED 25.08.2015.
THIS WRIT PETITION COMING ON FOR ORDERS, THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Sri.Shravan.S.Lokre, learned counsel for Sri.Suresh.S.Lokre for the petitioner. Sri Aditya Singh, learned CGSC for Sri C.Shashikantha, learned ASGI for the respondent.
2. The writ petition is admitted for hearing. With the consent of the parties, the matter is heard finally.
3. In this petition under Article 226, the petitioner inter alia seeks direction to the respondent to consider the application submitted for renewal of the Passport of the petitioner.
4. When the matter was taken up for consideration today, learned Central Government Standing Counsel submitted that the Central Government has issued new guidelines in the year 2016 and the petitioner is required to submit a fresh application under the new guidelines and in case, the petitioner submits such an application, the same shall be considered in accordance with law.
5. On the other hand, learned counsel for the petitioner submits that the petitioner would submit an application under the new guidelines within a period of one week from the date of receipt of certified copy of the order passed today and shall comply with all the formalities prescribed in the application.
6. In view of the aforesaid submissions and in the facts of the case, writ petition is disposed of with a direction to the respondent that in case the petitioner files an application for issuance of passport under the new guidelines issued by the Central Government in the year 2016, appropriate decision on the aforesaid application shall be taken in accordance with law by the Competent Authority within a period of four weeks therefrom.
Accordingly, the petition is disposed of.
