ORDER Heard the learned counsel for the petitioners and the learned High Court Govt. Pleader.
2. The second respondent is the complainant. Petitioners claim to be a purchaser of the property owned by the second respondent. It is the grievance of the second respondent that a fake gift deed has been fabricated in the name of her son and based on the fabricated gift deed, a registered sale agreement has been executed in favour of the petitioners and that the petitioners and other accused have attempted to defraud the complainant. It is relevant to note that the complainant has lodged a complaint even against her own son.
3. Learned High Court Govt. Pleader would contend that the property involved, is worth crores of rupees and the petitioners cannot claim innocence in the matter and that the matter requires investigation and prays that the petition be rejected.
4. As rightly contended by the learned High Court Govt.
Pleader, the matter is still at an nascent stage, any intervention at this stage would only embolden the accused to further the crime. Hence, the petition stands rejected.
5. In view of disposal of the above petition, I.A. 1/19 for stay does not survive for consideration and is accordingly disposed off.
