This writ petition is directed against an order dated 14.1.2018, which records that petitioner had obtained appointment on the basis of forged High School Certificate, and therefore, the same is being cancelled. While filing the present writ petition, petitioner had annexed the High School Certificate, which according to him was the correct High School Certificate. This certificate is at page 26 of the writ petition. As per the certificate, petitioner had passed High School in 1983 and was allotted Roll No.498908.
While entertaining the writ petition, following orders were passed on 21st March, 2018:-
"Petitioner is permitted to implead U.P. Madhyamik Shiksha Parishad, Allahabad through its Secretary. Notice on his behalf has been accepted by learned Standing Counsel.
The order impugned records that petitioner had obtained appointment on the basis of forged high school certificates, and therefore, such appointment is cancelled.
Learned counsel for the petitioner states that he has not been heard in the matter and that the certificate in fact is genuine. The high school certificate and mark sheet are annexed at page 26 and 27 of the writ petition.
Learned Standing Counsel is directed to get it verified from the High School Board, Allahabad as to whether certificates relied upon by the petitioner are genuine or not? A specific report in that regard would be received within a week.
Put up as fresh on 29.3.2018."
Learned Standing Counsel has obtained specific instructions from the Secretary, Madhyamik Shiksha Parishad, U.P. Allahabad, as per which the Roll No.498908 in High School Examination was allotted to one Braj Mohan Singh Chauhan, son of Harvansh Singh, and such roll number was never allotted to the petitioner. The letter of the Secretary dated 22nd March, 2018 is kept on record.
From the facts, noticed above, this Court is satisfied that petitioner had obtained appointment on the basis of fraudulent misrepresentation made before the authorities. The cancellation of his appointment, once such facts have been brought to the notice of the authorities, does not suffer from any infirmity.
Since the petitioner has approached this Court with forged documents also, this writ petition is dismissed with costs, assessed at Rs.5,000/-.
