Heard Sri Surya Prakash Singh, learned counsel for the petitioner, learned standing counsel for respondent no.1 and Sri Saheb Tiwari, for respondent no.2.
The petitioner is one of the five sons of late Suleman Ali, who died-in-harness on 21.10.2018. According to petitioner, Late Suleman Ali left a registered will. There is a dispute in regard to the said will. A suit has been filed before the Civil Judge (Junior Division), Firozabad for declaring the will null and void by the brother of the petitioner. The petitioner contends that no interim order has been passed by the court below as such a direction be issued to respondent to consider the application of petitioner for grant of compassionate appointment.
In view of the fact that the will left by Late Suleman Ali is under challenge by other brothers of petitioner, as such no interference is required at this stage till the decision in regard to cancellation of the will is taken by the court below.
Writ petition is misconceived and is dismissed.
