SPP for R1; R2-Party-in-Person,) This Criminal Revision Petition is filed under Section 397 r/w 401 of Cr.P.C praying to set aside the impugned order dated 30.04.2018 passed in C.C.No.3239/2017 pending on the file of II ACMM, Bengaluru as per Annexure-A and thereby allow the application filed by the petitioner/accused under Sections 239, 240 of Code of Criminal Procedure by allowing the above petition with Exemplary Cost.
This Criminal Revision Petition coming on for Admission, this day the Court made the following:-
O R D E R Heard the learned counsel appearing for the petitioner and the learned Additional S.P.P. for respondent No.1 and respondent No.2 who is appearing as party-in- person.
2. After hearing the learned counsel appearing for the parties in length including respondent No.2-Madhu D., who is appearing as party-in-person, by filing a memo yesterday requesting this Court to permit her to argue the case as party-in-person, the learned counsel for the petitioner submits that he has urged many good ground before this Court and he has got a good case. However, he reserves his right to put-forth of this defence before the Court below at the time of trial and during the course of cross-examination.
By reserving liberty as stated above to the learned counsel for the petitioner-accused, the case is disposed of.
