Dildar Shiralli, HCGP for R-1, R-2 served and unrepresented) This Criminal Petition is filed under Section 482 of Cr.P.C. praying to quash the entire proceedings in C.C.No.617/2008 (Crime No.141/2008) pending on the file of the Prl. Civil Judge and JMFC, Harihara, Davanagere District.
This Criminal Petition coming on for Admission, this day, the Court made the following:
ORDER Petitioner has sought for quashing the charge sheet laid against him for the alleged offence punishable under Section 420 of IPC.
2. When the matter is taken up for hearing, learned counsel for the petitioner submitted that the trial has commenced and already substantial witnesses are examined before the trial Court.
3. In view of these submissions, it is not appropriate to exercise the jurisdiction under Section 482 of Cr.P.C. at this stage. Hence, the petition is dismissed.
Since the charge sheet is of the year 2008, the trial Court is directed to expedite the matter and conclude the trial within an outer limit of six months from the date of communication of this order.
