THE WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO CALL FOR ENTIRE RECORDS, INCLUDING THE EVIDENCE OF DW2 IN O.S.NO.1767/2011 PENDING ON THE FILE OF 56TH ADDITIONAL CITY CIVIL AND SESSIONS JUDGE (CCH-57) BENGALURU AND QUASH THE RECORDING OF THE REMARKING STATEMENT MADE AGAINST THE PETITIONER DATED 01.08.2019 BY THE 56TH ADDITIONAL CITY CIVIL AND SESSIONS JUDGE (CCH-57) BENGALURU UNDER ANNEXURE-A.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R Party-in-person has presented the petition against the order dated 01.08.2019 passed by learned Prl. City Civil & Sessions Judge, Bengaluru in O.S.No.1767/2011, mainly on the ground that adverse remarks are made against him- counsel for defendant No.10.
2. A careful perusal of the impugned order dated 01.08.2019, it is seen that the Sessions Judge has only observed that ‘SPL asking question very lately and causing inconvenience to the court proceeding’. The same does not amount to any adverse remarks against the counsel. The Court and learned counsel should go together to put an end to the litigation which would be the right approach in the interest of public. Hence, the observations made by the Court below shall not come in the way of counsel for defendant No.10-present petitioner-party-in-person to proceed cross-examination in accordance with law on the next date of hearing.
Accordingly, the writ petition is disposed off.
