Sri Guput Pal vs State Of U P And Others

High Court Of Judicature at Allahabad|22 February, 2019
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 42065 of 2002 Petitioner :- Sri Guput Pal Respondent :- State Of U.P. And Others Counsel for Petitioner :- S.N. Tiwari Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of the petitioner to press this writ petition. Learned Standing Counsel is present for respondents.
2. By means of the present writ petition, petitioner has sought following reliefs:
"i. to issue a writ, order or direction in the nature of mandamus directing the respondents to release the petitioner's pension and other benefits in pursuance of the government order dated 1.7.1989, 19.9.2001 and 19.10.2001 and annexure no. 3, 5 and 6 to this writ petition respectively.
ii. to issue a writ, order or direction in the nature of mandamus directing the respondents to decide the petitioner's representation in the light of government order dated 1.7.1989 and the order dated 19.9.2001 and 10.10.2001 as Annexure- 5 and 6 to this writ petition."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
