HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.15011 of 2014 ORDER:
Responding to the tender notice, dated 04.10.2013, for providing Sanitation and Security Services in Osmania General Hospital, Osmania Medical College and Government Dental College and Hospital, Hyderabad, the petitioner participated by submitting his tenders. Technical Bids of the tenders were opened on 21.04.2014 and financial bid on 16.05.2014. This writ petition is instituted alleging that the financial bid submitted by the petitioner was not opened and the same is illegal and amounts to arbitrary exercise of power.
2. When the writ petition is taken up for consideration, learned Standing Counsel representing the Telangana Medical Service and Infrastructure Development Corporation (2nd respondent) submitted that the bid submitted by the petitioner was scrutinized and having noticed the deformities in the submission of bids, it was treated as non-qualified bid. A letter, dated 02.06.2014, which was addressed to the petitioner is produced, copy of which is served on the learned counsel for the petitioner.
3. In view of the decision of the second respondent Corporation rejecting the bid submitted by the petitioner and communicating the decision in this regard, the cause in the writ petition does not survive. It is open to the petitioner to work out its remedies consequent to the letter, dated 02.06.2014, copy of which is served on the learned counsel for the petitioner.
4. Leaving it open to the petitioner to work out remedies, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
