THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No. 921 of 2014 JUDGMENT: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) We are not inclined to entertain this appeal, as we feel that the learned Trial Judge has given enough protection. Moreover, the learned counsel for the State informed us that the appellant has accepted the impugned judgment and order.
In these circumstances, to put an end to the matter, we direct the appellant to vacate the premises in question as has been directed by the learned Trial Judge within a period of one month from today, failing which, it would be open for the respondent authorities to take forcible possession. At the same time, the respondent authorities shall ensure payment of compensation as quantified.
Learned counsel for the State submitted that the compensation amount is made ready to be handed over to the appellant. It is open for the appellant to receive the said amount with a lawful and valid discharge.
Subject to the above observations, the appeal is disposed of.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
