This Criminal Petition coming on for Admission, this day, the Court made the following:-
O R D E R Petitioner has assailed condition No.1 imposed in the order dated 29.9.2018 in Crl.A.No.1920/2018 on the file of learned LX Additional City Civil and Sessions Judge, Bengaluru.
2. Having regard to the provision contained under Section 148 of the Negotiable Instruments Act, the minimum deposit of fine amount is 20%, whereas the Court below has imposed a condition to deposit 50% of the total fine amount imposed by the learned trial Court within 60 days, which is reasonable, having regard to the facts of the case. Hence, petitioner has not made out a case to interfere with the order dated 29.9.2018 passed in Crl.A.No.1920/2018.
3. Accordingly, petition stands dismissed.
Consequently, I.A.No.1/2018 filed for stay, is also dismissed.
