Respondent This Criminal Petition is filed under Section 438 of Cr.P.C. praying to enlarge the petitioner on bail in the event of his arrest in Cr.No.281/2016 of Srirangapatna Police Station, Mandya for the offences P/U/S 395, 363, 342 r/w 149 of IPC.
This Criminal Petition coming on for orders this day, the Court made the following:
ORDER Heard Sri. Rahul Rai, learned counsel for the petitioner and Sri.Vishwamurthy, learned HCGP for respondent State.
2. The petitioner is seeking for anticipatory bail in respect of the charge sheet submitted by the respondent- police in respect of the offence punishable under Sections 395, 363, 342 read with Section 149 of IPC, is arrayed as accused No.6.
3. The allegation is about offence of dacoity in a lorry in respect of 52 oil pockets. The accused Nos. 2, 3, 5, 7 and 8 are enlarged on bail by the order of this court. As the charge sheet indicates, not the entire stolen property is recovered from the possession of the arrested accused persons. After the arrest of the absconding accused, investigation is yet to be carried out in respect of the remaining stolen oil pockets. That being so, the petitioner has to surrender before the concerned IO and convince him about his innocence.
With the above observations, petition is dismissed.
