This writ petition is filed under Articles 226 & 227 of the Constitution of India, praying to direct the respondent to provide sufficient proof of the entries with documents in accordance with the requests made at Annexures-H & J.
This petition coming on for Orders, this day, the Court made the following:
ORDER When the matter is taken up today, learned Counsel for the respondent-Bank submits that in compliance of the interim order 12.12.2017 passed by the Bench of this Court, the petitioner and his representatives have been permitted to inspect the records of the bank and even they were also permitted to verify the account details as sought for by them in Annexure-L, about six months ago. It is further submitted that nothing survives for consideration in this writ petition. It is further pointed out that the respondent-Bank has already filed a Original Application before the Debts Recovery Tribunal, where similar contentions as raised in this petition have been raised.
2. In view of the aforesaid submissions, nothing survives for consideration in this writ petition, needless to state that the petitioner shall be at liberty to take all contentions as are permissible to him in law in the proceedings which are pending before the Debts Recovery Tribunal. Accordingly, petition is disposed of.
