State of Karnataka By Challakere Police Station, Chitradurga District -577 522. … Respondent (By. Sri. S. Vishwamurthy, HCGP) This Criminal Petition is filed under Section 438 of Cr.P.C. praying to enlarge the petitioner on bail in the event of their arrest in crime No.92/2017 of Challakere Police Station, Chitradurga District for the offence p/u/s 120 (B), 188, 379 of IPC and Section 7 of SPECIFIC BANK NOTE ACT, 2017.
This Criminal Petition is coming on for orders this day, the Court made the following:
ORDER Heard the learned counsel for the petitioner and the learned HCGP for the respondent.
2. Petitioners arrayed as accused No.4 in the remand application.
3. Petitioner apprehend his arrest by the respondent police in their crime No. 92/2017 registered by the respondent police in respect of the offence punishable under Section 120(B), 188, 379 of IPC.
4. The allegation is, petitioner handed over demonetized currency notes of value Rs.1.00 Crore through accused No.3 to accused No.1 and 2 for exchange of fresh currency notes etc. The demonetized currency notes was seized by the Investigating Officer from the possession of the accused No.1 and 2. He is implicated on the voluntary statement of arrested accused No.3. and allegations are triable at Magistrate Court.
5. The petition is allowed. Petitioner is granted anticipatory bail in crime No. 92/2017 registered by the respondent police subject to the condition:
He shall forthwith appear before the respondent Investigating Officer. The Investigating Officer is at liberty to interrogate him. In case of his arrest by the respondent Investigating Officer in respect of the above offence he shall be released on bail on executing a self bond for a sum of Rs.50,000/- with one surety to the likesum. He shall cooperate with the Investigating Officer during further course of investigation.
