Heard learned counsel for the petitioner.
By means of this petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"(i) Issue an appropriate order or direction, direct to the Civil Judge (J.D.) F.T.C. Gorakhpur to decide the Suit No.70 of 1997 (Smt. Jasoda (now deceased) and another Vs. Smt. Mansila and another) in a stipulated period pending in the court of Civil Judge (J.D.) F.T.C. Gorakhpur."
Perusal of the ordersheet transpires that the evidence of the petitioner-plaintiff has come to be concluded and now the case is at the stage of defendants' witness.
In such above view of the matter, the petition is disposed of with direction that the court shall conclude the evidence of the defendants within the next six months and the proceedings of the suit thereafter shall be concluded thereafter within next one year from the date of production of copy of this order.
It is clarified that time frame provided for disposal of the case shall be deemed to be extended in the event concerned District is hit by another surge of pandemic (SARS COV-2/COVID 19) resulting in the suspension of public movement and/or judicial work in the District concerned.
