Heard learned counsel for the petitioner, learned Government Pleader for Revenue appearing for respondents 1 and 2 and learned counsel for third respondent.
The order impugned in this writ petition is clearly appealable order and hence I am not inclined to entertain this writ petition, as it involves adjudication of disputed facts which can be more appropriately dealt with and examined by the appellate authority.
The writ petition is, therefore, disposed of granting liberty to the petitioner to file an appeal against the impugned order before the appellate authority along with an application for condonation of delay, if any and on filing such application, the appellate authority shall consider the same in the light of attending circumstances as well as the circumstance that the petitioner has impugned the order before this Court in this writ petition and examine the reasons for the delay and pass appropriate orders after hearing the parties, in accordance with law. Miscellaneous applications, if any, shall stand closed. No costs.
