Heard learned counsel for the petitioner.
Objection filed by the petitioner under Section 9 of the U.P. Consolidation of Holdings Act was allowed by the Consolidation Officer vide order dated 13.11.1996. The order was challenged by filing a highly belated appeal along with an application under Section 5 of the Limitation Act.
The Settlement Officer vide order dated 18.08.2005 allowed the application under Section 5 against which the petitioner preferred a revision. It is contended that the Revision was dismissed in default on 29.01.2010 and restoration application dated 23.03.2010, is pending disposal. It is further contended that without there being any final adjudication by the authorities with respect to the rights of the parties over the land in dispute, Respondents authorities are forcibly trying to demolish the standing construction, in which Girls Degree College is being run.
Considering the facts and circumstances, this writ petition stands disposed of finally with a direction that the respondents authorities will not demolish the construction or dispossess the petitioner from the land in dispute in accordance with law.
