THESE PETITIONS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Sri T Ramesh Babu, Tahsildar, Mysuru, is present before the Court pursuant to the order of this Court dated 12.7.2019 to consider the prayer of the petitioners in this writ petition.
2. In this proceedings, the petitioners are seeking a writ of mandamus directing the Tahsildar of Mysuru, who is a sole respondent in this proceedings to consider his representation dated 11.10.2013 and consequently to register the khata and RTC of the land in sy.No.115 of Keragalli village, Jayapura Hobli, Mysuru Taluk, measuring to an extent of 3 acres with boundaries as stated in the memorandum of writ petition in their name.
3. The Tahsildar, who is present before the Court would submit that according to the information available on record the aforesaid land bearing sy.No.115 of Keraghalli village, Jayapura Hobli, Mysuru Taluk, measuring 3 acres is utilized for formation of residential sites by MUDA in R.T. Nagara Extension of Mysuru. Therefore, at present the said land is not available with the petitioners. According to him, the compensation awarded for acquisition of the said land has already been paid and all the land owners have received the compensation. Insofar as the petitioners are concerned, he is not certain whether they have received compensation or not.
4. In this background, the Tahsildar of Mysuru is hereby directed that within 10 days from today he shall look into the records and pass necessary orders against the representation dated 11.10.2013 made by the petitioners vide Annexure-C. In the event, if it is found that the land in question is already acquired by the MUDA, the petitioners have to be informed by a communication in that behalf.
While doing so, if he is able to secure any information regarding compensation received by the petitioners, the same shall be noted in the said communication.
With such observations, the writ petitions are disposed of.
