Ravichander, appearing for the appellant, fairly submits upon instructions that the order of the revising authority passed in favour of his client may be set aside. He also fairly submits that the writ petitioners were affected persons in the decision making process with regard to the land in question, made by revising authority.
In that view of the matter, we dispose of the appeal and also set aside the order of the revising authority. We direct the revising authority to serve notice upon the writ petitioners and hear the matter afresh without being influenced or swayed by his earlier findings and observations. He shall take note of the representation of the writ petitioners and also that of appellant before us and then pass a speaking order. The entire exercise shall be completed within a period of two months from the date of communication of this order. All questions are kept open.
In view of this judgment, nothing remains in the writ petition. So, the interim order passed by the learned trial Judge also stands set aside and it would be open for the parties to approach the learned trial Judge for final disposal of the matter on production of this judgment.
The writ appeal is accordingly disposed of.
Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
