Heard learned counsel for the petitioner and learned Standing Counsel for the State- respondents.
The writ petition arises out of proceedings for mutation and is directed against the order dated 19.02.2018 and the order dated 10.08.2016 passed by the respondent Nos. 3 and 4, respectively.
During the course of the arguments, learned counsel for the petitioner admits that a civil suit is already pending between the parties.
Under the circumstances and since the proceedings where from the writ petition arises, are purely summary in nature, and have fiscal connotations. Besides being summary in nature, they do not determine the title of the parties thereto.
This writ petition is disposed of with the observation that the order impugned in the writ petition shall be necessarily abide by the final judgement by the civil suit, between the parties.
