This Criminal Petition is filed under Section 438 of Cr.P.C., praying to enlarge the petitioners on bail in the event of their arrest in Cr. No. 515/2016 of Channarayapatna town Police Station, Hassan District for the offences p/u/s 448, 379 R/w 34 of IPC.
This criminal petition coming on for orders this day, the Court made the following:
O R D E R Heard the learned counsel for the petitioners and the learned High Court Government Pleader for the respondent.
2. The respondent – Channarayapatna Town Police registered a case in Crime No. 515/2016 against the petitioners in respect of offences punishable under Sections 448, 379 r/w Section 34 of IPC. The petitioners are alleged to have cut the standing tree in the premises of official quarters of the Judicial Officer at Channarayapatna.
3. Having regard to the nature of the allegation, there is no impediment to grant anticipatory bail to the petitioners .
4. Accordingly, petition is allowed. The petitioners are granted anticipatory bail in Crime No.515/2016 registered by the respondent-Police.
In the event of their arrest by the Investigating Officer in respect of the above case, they shall be released on bail on each of them executing a self bond for a sum of Rs.50,000/- with one surety for the likesum.
They shall appear before the Investigating Officer and the Investigating Officer is at liberty to interrogate them.
