ORDER Learned counsel for the petitioner filed a memo, which reads thus.
“The above named petitioner humbly submits that the above petition filed under Section 438 of Code of Criminal Procedure seeking anticipatory bail and in the anticipation of arrest by the Respondent Police.
The petitioner during pendency of the above petition surrendered before the Respondent police and the petitioner now in judicial custody. Hence this petition will become infructuous in the eye of law.
Wherefore, the named petitioner humbly submits that pleased to withdraw the above petition as not pressed for the above said reasons, in the interest of justice.”
