(By Sri.Ashwin S.Halady, Advocate for R5 ...Respondents Sri.Sreedhar.N.Hegde, HCGP for R1 and R2 R3 and R4 served but unrepresented) This Writ Petition is filed under Article 226 of Constitution of India praying to quash the order official memorandum dated 30.03.2015 (Annex-C) and official memorandum dt.7/2015 (Annexure-F) passed by R-2 as the same are illegal, arbitrary and in violation of principles of natural justice.
This Writ Petition coming on for Preliminary hearing in ‘B group this day, the Court made the following:-
ORDER In the instant petition, petitioner has sought for quashing of the official memorandums dated 30.03.2015 Annexure-C and 07/2015 Annexure-F respectively.
2. Petitioner had benefit of interim order and continued as Assistant Revenue Officer, City Corporation, Shimoga. As on the date of filing of present petition, he was aged about 58 years. As on this day, he must have attained the age of superannuation and retired from the service. Therefore, present writ petition does not survive for consideration.
Accordingly, petition stands disposed of.
