JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE C.V.NAGARJUNA REDDY Civil Miscellaneous Appeal No.157 of 2014 Between:
Dated 18th June, 2014 Sri Bhavannarayana Swamy Temple And D.Venkata Raman Babu and another …Appellant …Respondents Counsel for the appellant: Sri V.S.K.Rama Rao for Sri V.T.M.Prasad Counsel for the respondents: Sri Krishna Mohan Sikharam The Court made the following:
ORDER:
This civil miscellaneous appeal is filed against order, dated 07.02.2011, in O.A.No.1351 of 2010, on the file of the A.P.Endowments Tribunal at Hyderabad.
On 11.06.2014, when this case came up for hearing, Sri V.S.K.Rama Rao, learned counsel, representing Sri V.T.M.Prasad, learned counsel for the appellant, fairly stated that this appeal is covered by order in C.M.A.No.1131 of 2012 (mistakenly mentioned as C.M.A.No.1131 of 2011 in the order). In the light of the said submission, the case was adjourned with the direction to the Registry to put up a copy of the said order.
Accordingly, the Registry has placed the order in the said case, a perusal of which would show that the appeal filed by the appellant against an order similar to the one impugned in this appeal was declared as not maintainable as the Executive Officer of the temple has no locus standi to question the order of the Endowments Tribunal declaring a person as descendent of the hereditary trustee.
Following the above-noted judgement, this appeal is dismissed. As a sequel to dismissal of the civil miscellaneous appeal, pending interlocutory applications shall stand disposed of as infructuous.
