THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Mr.Nataraj C.D., learned counsel for the petitioner.
None for the respondent.
2. Petition is admitted for hearing.
3. In this petition under Articles 226 and 227 of the Constitution of India, petitioner has challenged the validity of the order dated 09.08.2018 passed on I.A.No.1 filed under Section 24 of the Hindu Marriage Act by which Family Court has awarded Rs.10,000/- as maintenance to the respondent.
4. When the matter is taken up today, petitioner submitted he has filed petition under Section 13 of the Hindu Marriage Act in the year 2017 and the writ petition may be disposed of with a direction to the trial court to conclude the proceedings expeditiously in a time bound manner.
5. Taking note of the provisions contained in the Karnataka (Case Flow Management in Subordinate Courts) Rules, 2005 which mandates that petition filed under Section 13 of the Hindu Marriage Act shall be disposed of within one year, petition is disposed of with a direction to the Family Court to dispose of the proceedings pending before it within six months from the date of receipt of certified copy of the order passed today.
Accordingly, petition is disposed of.
