Court No. - 44
Case :- CRIMINAL MISC. BAIL APPLICATION No. - 29843 of 2019 Applicant :- Sri Bhagwan And 5 Others Opposite Party :- State Of U.P.
Counsel for Applicant :- Mithilesh Kumar Shukla,Avanish Kumar Shukla Counsel for Opposite Party :- G.A.
Hon'ble Ramesh Sinha,J.
Heard Sri M.K. Shukla, learned counsel for the applicants, Sri G.P. Singh, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that there is a family dispute between the parties on account of which present F.I.R. has been lodged by the complainant. The applicant has no criminal antecedents.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that in the present case four persons have received injuries on their person.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicants Sri Bhagwan, Dharamveer, Manoj, Jagveer, Shayambeer and Gaurav involved in Case Crime No. 65 of 2019 under sections 147, 148, 323, 324, 325, 452, 326, 504, 506 I.P.C., police station Jagner, District Agra.
Accordingly, the anticipatory bail application is rejected.
However, the applicants will be at liberty to move regular bail application under section 439 Cr.P.C., if so advised.
