Sri Rakesh Bhushan Dubey holding brief of Sri V.K. Tripathi, learned counsel for the petitioner prays for adjournment of the case. On the request of learned counsel for the petitioner, case has been adjourned on 11.08.2021, 16.09.2021 and 02.11.2021. Today, request for adjournment of case has been made, which is rejected.
Heard learned counsel for the parties.
The petitioner by means of present writ petition has challenged the order dated 09.07.2012 passed the respondent no.5-Chief Development Officer, Mirzapur whereby certain claims of the petitioner has been rejected.
The petitioner has retired as Senior Clerk from District Development Office, Mirzapur on 31.10.1998. It appears that certain retiral dues has not been paid to the petitioner which grievance has been agitated by him and when no heed was paid to him, he approached this Court by filing Writ-A No.10390 of 2012 which was disposed of vide judgement dated 27.02.2012 directing the Chief Development Officer, Mirzapur to consider the grievance of the petitioner. The Chief Development Officer, Mirzapur by a detailed order dated 09.07.2012 rejected the claim of the petitioner.
The petitioner thereafter preferred Writ-A No.57101 of 2014 which the petitioner got dismissed as withdrawn with liberty to file afresh on 29.10.2014. In the said writ petition, the petitioner had assailed the order dated 27.02.2012 which is assailed in the present writ petition.
The Stamp Reporter has reported delay of about 3217 days in filing the present writ petition. The petitioner has not given any explanation of delay of about nine years in filing the present writ petition, and as there is an inordinate delay and laches in filing the present writ petition, this Court is not inclined to entertain the writ petition.
Accordingly, the writ petition is dismissed on the ground of delay and laches.
